Section 1. Organizer of the Promotion/Raffle
1.1. The "Win an iPhone 17 Pro Max with ProCredit" raffle (hereinafter referred to as "the Raffle") is organized by B.C. "ProCredit Bank" S.A. (hereinafter referred to as "the Bank" or "the Organizer"), fiscal code 1007600059183, headquartered at: 65 Ștefan cel Mare și Sfânt Blvd., office 901, MD-2001, Chișinău, Republic of Moldova.
1.2. Participants in the raffle are required to comply with the provisions of these Rules.
1.3. The Rules can be consulted on the official website of the Bank: www.procreditbank.md/en/regulament_tombola.
1.4. The Bank reserves the right to unilaterally modify the conditions of these Rules during the course of the Raffle, as well as the right to suspend and/or terminate and/or interrupt and/or extend the Raffle, without compensation. Changes will take effect only after prior publication on the Bank's website: www.procreditbank.md, at least 10 working days before the actual date of the changes. The Bank assumes no responsibility for whether Participants become aware of the changes published on the Bank's website.
1.5. The Rules are drafted in Romanian, Russian, and English.
Section 2. Legal Basis
2.1. The Rules are drawn up in accordance with the Civil Code of the Republic of Moldova no. 1107 of 06.06.2002, the Fiscal Code of the Republic of Moldova no. 1163 of 24.04.1997, Law no. 231 of 23.09.2010 on domestic trade, Law no. 105 of 13.03.2003 on consumer protection, Law no. 133 of 08.07.2011 on personal data protection, and the Bank's internal normative documents.
Section 3. Place of the Raffle
3.1. The raffle takes place in all branches of the Bank.
3.2. For additional information, participants may contact Customer Support (phone: 0800 000 10 for national calls, +373 22 27 07 07 for international calls. Working hours: Monday – Friday, 8:00 – 18:00, except public holidays), or by sending an email to: mda.office@procredit-group.com.
Section 4. Duration of the Raffle
4.1. The raffle takes place from 10.12.2025 to 31.01.2026, inclusive.
4.2. The Bank reserves the right to modify the duration of the raffle, with prior announcement published on www.procreditbank.md in accordance with the conditions indicated in point 1.4.
Section 5. Participation Conditions
5.1. Only natural persons residing in the Republic of Moldova who, during the raffle period indicated in point 4.1, cumulatively meet both of the following conditions are eligible:
- Become clients of the Bank through the online ProDigital platform (/ro/prodigital);
- Open a ProClassic deposit online with a minimum of 20,000 (twenty thousand) MDL, 1,000 (one thousand) EUR, or 1,000 (one thousand) USD, according to the conditions found at /ro/content/proclassic. The deposit must be active at the end date of the raffle.
- Individuals who meet the above criteria will be automatically entered into the Raffle.
- Clients who already have an account with the Bank at the start date of the Raffle are not eligible to participate.
5.2. Participants must hold a valid identity document issued by the National Passport System of the Republic of Moldova.
5.3. Persons affiliated with the Bank, as defined by the applicable legislation of the Republic of Moldova; Bank employees and their affiliates, may not participate in the raffle. Affiliates of Bank employees include family members (spouses, first and second-degree relatives/in-laws), persons living in the same household as the employee, as well as any individual or legal entity with direct contractual relations with the Bank or who, through their relationship with the employee, could benefit from an undue advantage.
5.4. The Bank reserves the right to disqualify from the Raffle or to cancel the decision by which a participant is designated as a winner, if the participant has not complied with one or more participation conditions and/or has not provided correct contact details and/or participated using false data.
Section 6. Raffle Prizes
6.1. The prize pool consists of 3 (three) iPhone 17 Pro Max phones.
6.2. Each participant can win a maximum of one prize.
Section 7. Winner Selection and Prize Awarding
7.1. The draw will take place within a maximum of 10 (ten) working days from the end date of the raffle, via the platform www.random.org, in the presence of a committee formed of representatives from the responsible departments of the Bank. The draw will take place at the headquarters of B.C. "ProCredit Bank" S.A., 65 Ștefan cel Mare și Sfânt Blvd., office 901.
7.2. For each prize, a single winner will be designated. If the designated winner does not claim the prize within 7 (seven) working days, calculated from the first working day after the draw date, the organizer will designate a new winner.
The new winner will be selected on the next working day following the expiration of the above term, through a new draw conducted according to the procedure in point 7.1 of these Rules.
The initial winner who does not claim the prize within the established term loses any possibility of subsequent claim, without prior notification from the organizer.
7.3. Prizes will be awarded only to participants who meet all participation conditions.
7.4. The Bank will contact the winners by phone and/or email on the day they are designated. Winners will be invited to collect their prize at the central office of B.C. "ProCredit Bank" S.A., Chișinău, 65 Ștefan cel Mare și Sfânt Blvd., office 901.
7.5. Prizes may be collected by each winner personally or by their representative, based on a power of attorney, only in accordance with these Rules.
Section 8. Prize Alternatives
8.1. Prizes cannot be exchanged for cash or other products.
Section 9. Responsibility
9.1. The Bank is not obliged to provide any explanations to ineligible or non-winning persons.
9.2. The Bank is not responsible for any defects and/or technical or other non-conformities of the prizes offered.
Section 10. Data Confidentiality
10.1. By participating in the Raffle, participants express their consent to the collection, processing, and storage of personal data by the Organizer, exclusively for purposes related to the Raffle.
10.2. Participants' personal data will be processed in accordance with personal data protection legislation.
10.3. Personal data will not be disclosed to third parties, except as provided by the applicable legislation of the Republic of Moldova and these Rules.
Section 11. Termination of the Raffle
11.1. The raffle may be terminated in the event of an impediment beyond the Bank's control or other circumstances justifying the impossibility of continuing the raffle/promotion, with or without prior notice to participants on the Bank's official website: www.procreditbank.md.
11.2. The raffle is considered valid only if, during its period, at least 20 participants who have met all participation conditions are registered. Otherwise, it is canceled.
Section 12. Disputes
12.1. Any disputes will be resolved primarily amicably, and if not possible, by the competent courts of the Republic of Moldova.
12.2. Complaints regarding the organization or conduct of the Raffle may be sent in writing to the official address of the Bank indicated in these Rules, to any branch of the Bank, or by email: mda.office@procredit-group.com.
12.3. Complaints must be submitted exclusively during the Raffle period and/or within 5 (five) calendar days from the end date of the Raffle.
Section 13. Anti-Corruption Clause
13.1. "Act of corruption" means all or any of the actions or inactions punishable under applicable law, committed by participants, including:
the use, solicitation, receipt, or acceptance, directly or indirectly, for oneself or for another person, of material benefits or undue advantage;
the promise, offering, or illegal granting of material benefits or undue advantage to subjects of acts of corruption;
the promise, offering, or illegal granting of such benefits or undue advantages to public officials, persons with public dignity, persons managing a commercial, public, or other non-state organization, and other persons provided by law.
13.2. Participants declare and guarantee that they are familiar with the legislation applicable to acts of corruption and that they will not commit, directly or indirectly, any act of corruption during the raffle.
Section 14. Consent for Photography/Filming and Use of Image
14.1. By participating in the raffle, prize winners expressly consent to their image—through photography and/or video recording—being used by the Bank for marketing purposes on www.procreditbank.md and the Bank's social networks, without financial or material claims against the Bank.
14.2. Refusal to be photographed/filmed and/or to allow the use of the image for promotional purposes will be considered a refusal to claim the prize.
14.3. No minors will appear in the photographs and/or video recordings made according to point 14.1.
Section 15. Prize Taxation
15.1. Prizes awarded in the Raffle are subject to taxation according to the fiscal legislation of the Republic of Moldova, including Fiscal Code no. 1163 of 24.04.1997 (art. 12, art. 90¹, art. 33), as well as other relevant normative acts.
15.2. If the value of each prize awarded exceeds the annual personal exemption of 29,700 MDL, provided by art. 33 para. (1) of the Fiscal Code, the Bank will withhold from the winner and transfer to the state budget an income tax of 12% applied to the part of the prize exceeding this amount, in accordance with art. 90¹ para. (3³) of the Fiscal Code. The Bank will also issue the winning individual a Fiscal Invoice for the corresponding value of the purchased phone, including VAT.
15.3. Prizes will be awarded to the winner after the tax is withheld by the Bank. Proof of tax withholding will be provided to the winner upon request.
15.4. If the value of the prize does not exceed the personal exemption established by law, the prize is awarded without tax withholding.
15.5. Winners are not required to separately declare this income if the tax for the prize has been withheld by the organizing Bank.
